Late last week, the U.S. House of Representatives issued the latest and nearly final draft of its longstanding legislative package called the 21 st Century Cures Act (Cures) . Of specific concern to the home and specialty infusion community is a section in the bill which calls for ending Average Wholesale Price (AWP) reimbursement rates for Medicare Part B DME infusion drugs. The Cures legislation intends to abolish AWP rates and instead impose Average Sales Price (ASP) rates (+ 6%) for the DME home infusion drugs. The change to ASP would occur in 30 days—on January 1, 2017. Cures mandates the establishment of a service payment to providers of Part B DME infusion drugs but not until 2021. This is unacceptable. If there is to be an amendment to the bill (i.e. delaying ASP implementation), it would have to occur by tomorrow, Tuesday, November 29, 2016. The House will vote on the bill on Wednesday. A revised definition for the Discharge Reasons is also proposed to support data collection for the new benchmarking metrics. Deadline to submit comment is December 31.
